By using our application, you fully agree to these Terms and Conditions of Use (TCU). If you do not accept these terms, please refrain from using our services.

 
2. Access and Registration 

2.1 Access Conditions

• The application is available to users of legal age or minors with parental authorization.
• An Internet connection and a compatible device are required to use the application.
• The application may not be available in certain regions due to legal or technical constraints.

2.2 Account Creation

• Creating an account is mandatory to access the application’s features.
• Users are responsible for maintaining the confidentiality of their login credentials and all activities carried out under their account.

2.3 Accuracy of Information

• Users guarantee that the information provided during registration is accurate and up-to-date.

GastronomIA provides several subscription options:

• Freemium Version: Limited access to basic features, with advertisements.
• Paid Subscriptions: Ad-free access with advanced tools for professional use (e.g., planning, staff management).

Services are continuously evolving and may be updated to meet user needs.

 
4. Subscription and Payment Terms 

4.1 Subscription Types

1. Lite Freemium Version
• Free.
• Limited in the number of requests and features.
• GastronomIA watermark displayed on all shared content.
• Contains advertisements.
2. Lite Version
• Paid.
• Limited in the number of requests and features.
• GastronomIA watermark displayed on all shared content.
• No advertisements.
3. Standard Version
• Paid.
• Full access to all features.
• Limited in the number of requests.
• Includes 1 admin account and up to 8 employee accounts.
• GastronomIA watermark displayed on all shared content.
4. Premium Version
• Paid.
• Full access to all features.
• Unlimited number of requests.
• Includes 2 admin accounts and up to 25 employee accounts.
• No watermark displayed on shared content.

4.2 Payments and Renewals

• Payments are made directly via the secure in-app payment system, including credit card transactions.
• Subscriptions are billed annually, with the full amount charged at the time of subscription or renewal.
• Renewals are automatic unless canceled by the user in their account settings.
• Notifications are sent prior to renewal to allow users to modify or cancel their subscription.

4.3 Refunds

• No refunds will be issued once the subscription period has begun, except as required by law.

4.4 Non-Payment Termination

• Access to paid features will be suspended in case of non-payment until the issue is resolved.

4.5 Trial Period

• A 30-day free trial is offered for all new accounts.
• During this period, users have full access to all GastronomIA features, regardless of subscription type.
• No charges will be applied during the trial period unless the user subscribes before it ends.

5. Intellectual Property

• All application content, including generated recipes, is protected by copyright and belongs to GastronomIA Tech Sàrl.
• Any unauthorized reproduction, modification, or use of content is strictly prohibited.

6. Responsibility 

6.1 Limitation of Liability

• GastronomIA Tech Sàrl is not liable for losses, technical malfunctions, or errors in data generated by the AI.
• Users remain responsible for verifying the results provided (quantities, recipes, etc.).

6.2 Use of Generated Data

• Suggestions provided by the application (recipes, menus, etc.) are based on algorithms and do not replace the user’s professional judgment.

7. Privacy and Data Protection

8. Termination

• Users can cancel their subscription at any time through the app’s settings.
• Access to paid features will end at the expiration date of the current subscription.

9. Changes to the TCU

• GastronomIA Tech Sàrl reserves the right to amend these TCU at any time.
• Users will be notified of changes via email or in-app notification at least 30 days before they take effect.

10. Applicable Law and Disputes

• These TCU are governed by Swiss law.
• In case of disputes, the parties agree to prioritize amicable resolution before taking legal action in Neuchâtel's competent courts.
